Most controlled drugs have medical uses, others may be of scientific interest, so the Act allows the government to authorise possession, supply, production and import or export of drugs to meet medical or scientific needs. These exemptions to the general prohibitions are in the form of ‘regulations’ made under the Act. In doing so, the JCDU should seek to provide confidence to local government that this is a long-term commitment. It must also urgently develop a plan to reduce the demand for illegal drugs.

Stimulant Addiction

The supply and possession with intent to supply of Class A drugs, will almost always justify a prosecution. These are the most serious offences in the Act and will often attract substantial custodial sentences. Circumstances where a prosecution for such an offence is not in the public interest will be very rare. From 15 November 2011, the Home Secretary (HS) has been able to make a substance or product a temporary class drug by means of a Temporary Class Drug Order (TCDO). Convictions relating to temporary class drugs will attract levels of punishment similar to those for Class B drugs under the Act, with the exception of simple possession (not an offence under TCDO provisions). Another common form of prescription drug addiction is psychiatric drug addiction.

The importation or exportation of any controlled drug is prohibited unless it is done in accordance with the terms of a licence granted by the Secretary of State (Home Office) and in compliance with any conditions attached to the licence. On 14 August 2012, Section 10(7) of the Medicines Act 1968 was repealed. Section 10(7) provided an exemption in UK law from the requirement for a pharmacist to hold a Wholesale Dealer’s Licence if they trade in medicines in certain circumstances. A 16 or 17-year-old, when accompanied by an adult, can drink beer, cider, or wine with their meal. However, UK alcohol laws do not allow them to buy an alcoholic drink until they reach 18 years old.
